The 89th Texas Legislature recently passed Senate Bill 12, which requires school districts to notify parents of staff services related to mental health and to give parents/guardians the opportunity to opt out before mental health-related services are provided to their child. In schools, counselors may give mental health-related services as defined by statute. These services fall under the responsibilities outlined in the Texas Education Code.

In compliance with SB12, Howe ISD must provide parents with notice of school-based health-related services offered at the campuses their children attend. Services may be provided by qualified school staff, including nurses & athletic trainers. This consent does not take the place of an individualized health plan, 504 plan, or other legally required document.
A parent has the right to withhold/withdraw/decline consent for any health-related service. If consent is declined, the student will not receive the indicated services except in cases of immediate life-threatening emergencies. Parents will be called to pick up their child for assessment and/or treatment at home or outside provider.
